VAT ADVANTAGES: No Transfer Duty : When a VAT-registered buyer purchases from a VAT-registered seller, the property is subject to VAT rather than transfer duty. Since VAT replaces transfer duty, the buyer avoids the latter, which can often be a substantial cost. Input VAT Deduction : If the buyer intends to use the property in a VAT-registered enterprise, the VAT paid on the purchase price can typically be claimed as an input VAT deduction from the South African Revenue Service (SARS). This effectively reduces the buyer’s cost. Cash Flow Advantage : In certain cases, if structured correctly, the VAT paid can be offset against the business’s VAT output liability, enhancing cash flow management. Section 11(1)(e) - Zero-Rated Supply : If the property is sold as a "going concern" (e.g., rental property with ongoing leases), and all conditions are met, the transaction could qualify as zero-rated for VAT. This means no VAT is payable, significantly reducing the upfront financial burden for the buyer. Enhanced Investment Opportunities : VAT registration aligns with compliance and offers credibility, which can open doors to other business opportunities, partnerships, or financing that might not be as accessible to non-registered buyers.
